Best Builders provides professional construction services including, but not limited to:

All services are subject to availability, technical feasibility, and mutual agreement between the client and Best Builders.

4. Project Agreement and Quotations

4.1 Quotations

All quotations provided by Best Builders are valid for 30 days from the date of issue unless otherwise stated. Quotations are estimates based on the information provided and may be subject to revision based on site inspection, material costs, and project scope changes.

4.2 Project Contract

A formal written contract will be executed before commencement of any project. The contract will detail:

4.3 Project Changes

5. Payment Terms

5.1 Payment Structure

• Advance Payment: 30% upon contract signing
• Progress Payments: Installments based on project milestones (typically 40-50% in stages)
• Final Payment: 20% upon project completion and handover

5.2 Payment Methods

We accept payments through bank transfer, cheque, credit/debit cards, and online payment gateways. All payments must be made in Indian Rupees (INR).

5.3 Late Payments

Late payments may result in project delays and may incur interest charges at the rate of 2% per month on the outstanding amount. We reserve the right to suspend work if payments are not received as per the agreed schedule.

5.4 Refund Policy

Advance payments are non-refundable once work has commenced. In case of project cancellation, refunds will be processed after deducting costs incurred for work completed, materials procured, and administrative expenses.

6. Client Responsibilities

Clients engaging our services agree to:

• Provide accurate and complete information about the project requirements
• Obtain and provide all necessary permits, approvals, and legal clearances
• Ensure site accessibility and availability during working hours
• Make timely payments as per the agreed schedule
• Respond promptly to requests for decisions and approvals
• Maintain adequate insurance coverage for the property
• Provide utilities (water, electricity) required for construction work

7. Our Responsibilities and Commitments

Best Builders commits to:

• Deliver services with professional competence and care
• Use quality materials as specified in the contract
• Maintain safety standards at the construction site
• Complete projects within the agreed timeline (subject to unforeseen circumstances)
• Provide regular project updates and progress reports
• Address defects covered under warranty provisions
• Maintain confidentiality of client information

8. Project Timeline and Delays

8.1 Timeline

Project timelines are estimated based on normal working conditions and are subject to factors beyond our control including weather conditions, material availability, labor availability, and client-caused delays.

8.2 Force Majeure

We are not liable for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to natural disasters, government actions, strikes, pandemics, material shortages, or acts of God.

8.3 Client-Caused Delays

Delays caused by late client decisions, payment delays, unavailability of site access, or changes in project scope may result in timeline extensions and potential additional costs.

9. Quality Assurance and Warranty

9.1 Workmanship Warranty

Best Builders provides a warranty on workmanship for a period of 12 months from the date of project completion, covering defects arising from our construction work (excluding normal wear and tear).

9.2 Material Warranty

Materials are warranted as per the manufacturer's warranty terms. We will assist in facilitating warranty claims but are not responsible for manufacturer defects.

9.3 Exclusions

Warranties do not cover:

• Damage caused by improper use or maintenance
• Alterations made by third parties after project completion
• Normal wear and tear
• Damage from natural disasters or acts of God
• Issues arising from client-supplied materials or designs

10. Intellectual Property

All designs, plans, drawings, and specifications created by Best Builders remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use these materials for the specific project but may not reproduce, distribute, or use them for other projects without our written consent.

11. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claims arising from our services shall not exceed the total contract value of the specific project
• We are not liable for indirect, consequential, or incidental damages
• We are not responsible for pre-existing conditions, structural issues, or defects not apparent during initial assessment
• Clients are advised to maintain adequate insurance coverage

12. Dispute Resolution

12.1 Amicable Resolution

In the event of any dispute, both parties agree to first attempt resolution through good faith negotiations and mediation.

12.2 Jurisdiction

These Terms and Conditions are governed by the laws of India. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

12.3 Arbitration

If mediation fails, disputes may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with arbitration proceedings conducted in New Delhi.

13. Termination

Clients may terminate the contract by providing 15 days written notice. Termination fees will include:

• Payment for all work completed to date
• Costs of materials procured and non-returnable
• Cancellation charges as specified in the contract (typically 10-15% of remaining contract value)

13.2 Termination by Best Builders

We reserve the right to terminate the contract if:

• Client fails to make payments as per agreed schedule
• Client breaches material terms of the contract
• Project becomes legally or technically infeasible
• There is unsafe or unethical conduct by the client

14. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We collect, use, and protect your personal information in accordance with applicable data protection laws. Please refer to our Privacy Policy for detailed information.

15. Safety and Compliance

Best Builders is committed to maintaining high safety standards and compliance with all applicable building codes, regulations, and safety norms. We expect clients and their representatives to cooperate with safety protocols at construction sites.

16. Photography and Marketing

Unless explicitly objected to in writing, Best Builders reserves the right to photograph completed projects for marketing and promotional purposes. We will not disclose client personal information without consent.

17. Subcontractors and Third Parties

Best Builders may engage qualified subcontractors and third-party specialists for specific aspects of projects. We maintain responsibility for work performed by our subcontractors and ensure they meet our quality standards.

18. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with a revised "Last Updated" date. Continued use of our services after such modifications constitutes acceptance of the updated terms. For ongoing projects, existing contracts will continue to be governed by the terms in effect at the time of contract signing.

19. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

20. Entire Agreement

These Terms and Conditions, together with the project contract and any written amendments, constitute the entire agreement between the client and Best Builders, superseding all prior discussions, negotiations, and agreements.
