📜 1. Acceptance of Terms

By accessing our website, submitting an inquiry, signing a construction agreement, or engaging our services in any manner, you agree to be legally bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not proceed with engagement.

These Terms & Conditions ("Terms") govern your use of the Best Builders website and all services provided by Best Builders, having its registered office at Shop No. 7, Shree Krishna Complex, Satellite, Ahmedabad, Gujarat 380015.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Best Builders concerning the subject matter herein. We reserve the right to modify these Terms at any time, and such changes will be effective upon posting on our website.

In these Terms, "Client", "you", and "your" refer to the individual or entity engaging our services. "Company", "we", "us", and "our" refer to Best Builders.

🏗 2. Services

Best Builders provides the following construction and related services:

  • Residential Construction — bungalows, villas, row houses, apartments
  • Commercial Construction — offices, retail outlets, showrooms, business complexes
  • Industrial Construction — factories, warehouses, industrial sheds
  • Interior Design & Fit-Out services
  • Renovation, Remodelling & Retrofitting
  • Architectural Drawing, Planning & 3D Visualization
  • RERA compliance documentation and regulatory liaison
  • Project management and site supervision

All services are subject to the execution of a formal written agreement, approval of drawings/specifications, and receipt of agreed advance payments. Engagement of our services does not guarantee specific outcomes not expressly stated in the signed project agreement.

We reserve the right to decline any project inquiry at our sole discretion without being required to provide a reason.

👥 3. Client Obligations

As a client engaging Best Builders, you agree to:

  1. Provide accurate, complete, and timely information necessary for project planning, design, and execution, including clear title/ownership documents for the property.
  2. Obtain all necessary approvals, permissions, NOCs, and permits from relevant authorities (municipal corporations, RERA, etc.) unless specifically agreed otherwise in the contract.
  3. Make all payments as per the agreed payment schedule without delay. Delays beyond 7 days may result in project suspension or interest charges.
  4. Provide timely decisions on materials, finishes, and design choices as requested by our team. Delays in client decisions may result in timeline extensions.
  5. Ensure safe and unobstructed access to the construction site during agreed working hours.
  6. Not engage any other contractors to work on the same project scope without our prior written consent, as it may compromise structural integrity and void warranties.
  7. Communicate all concerns, requests, or complaints through official channels (email or written communication) and not directly with individual workers on-site.
  8. Inspect and formally accept project deliverables at each milestone stage within the agreed timeframe.

💰 4. Pricing & Payment Terms

4.1 Quotations & Estimates

All quotations provided by Best Builders are valid for 30 days from the date of issue unless otherwise stated. Quotations are prepared based on information provided by the client at the time of inquiry and may be revised upon site inspection, change in material costs, or regulatory requirements.

4.2 Payment Schedule

A typical payment structure is as follows (subject to contract-specific terms):

  • Booking Advance (10–20%): Due upon signing the construction agreement
  • Foundation Stage (20–25%): Upon completion of foundation and plinth work
  • Structure Stage (25–30%): Upon completion of structural frame/slab work
  • Finishing Stage (20–25%): Upon completion of brick, plaster, and MEP work
  • Possession Stage (5–10%): Prior to project handover and key delivery

4.3 Late Payment

Payments overdue by more than 7 calendar days will attract a simple interest charge of 1.5% per month on the outstanding amount. Continued non-payment beyond 30 days may result in project suspension, and any costs incurred during suspension period shall be borne by the client.

4.4 Price Escalation

Construction material prices (steel, cement, sand, aggregate, etc.) are subject to market fluctuations. For projects exceeding 12 months, a price escalation clause may apply as per the terms specified in the individual project agreement. Best Builders will provide prior written notice of any price revisions.

4.5 GST & Taxes

All prices are exclusive of Goods and Services Tax (GST) and other applicable taxes unless specifically stated otherwise. GST at applicable rates will be charged separately on all invoices as per Government of India regulations.

5. Project Timeline & Delivery

Project timelines are estimated based on scope, site conditions, and material availability at the time of contract signing. While Best Builders is committed to meeting agreed timelines, the following events may cause extensions:

  • Acts of God — floods, earthquakes, cyclones, or other natural disasters
  • Government-imposed lockdowns, restrictions, or regulatory delays
  • Delays in client-supplied materials, decisions, or approvals
  • Unforeseen site conditions — soil problems, underground utilities, undisclosed structures
  • Changes requested by the client after commencement of work
  • Labour strikes, supply chain disruptions, or material shortages

Best Builders will notify the client in writing within 7 days of any event causing a delay. Timeline extensions due to client-related delays will be calculated and communicated accordingly.

✏️ 6. Changes & Variations

Any changes, modifications, or additions to the approved scope of work after execution of the agreement ("Variations") must be:

  1. Requested by the client in writing (email or letter)
  2. Assessed and quoted by Best Builders within a reasonable timeframe
  3. Approved in writing by the client before work commences
  4. Reflected in a formal Variation Order with revised costs and timeline impact

Verbal instructions for variations will not be accepted. Best Builders reserves the right to suspend work on variations until written approval and advance payment (if applicable) are received.

©️ 7. Intellectual Property

All architectural drawings, structural designs, 3D visualizations, project specifications, and related documents prepared by Best Builders remain the intellectual property of Best Builders until full payment of all associated fees is received.

Upon receipt of full payment, the client receives a limited, non-exclusive licence to use these documents for the purpose of constructing the agreed project only. Reproduction, modification, or reuse of our designs for other projects requires our express written consent.

All content on the Best Builders website — including text, images, graphics, logos, and videos — is the exclusive property of Best Builders and is protected by Indian copyright laws. Unauthorised reproduction or distribution is prohibited.

⚠️ 9. Limitation of Liability

Best Builders' total liability to the client under any construction agreement shall not exceed the total value of the fees paid by the client under that specific agreement. We shall not be liable for:

  • Indirect, consequential, or punitive damages
  • Loss of profits, business, or anticipated savings
  • Damage or loss arising from client-supplied designs, materials, or information
  • Delays or costs arising from Force Majeure events
  • Third-party actions, regulatory decisions, or utility failures outside our control

This limitation does not apply to liability arising from gross negligence, fraud, or wilful misconduct on the part of Best Builders or its employees.

🛡 10. Warranty & Defects Liability

10.1 Structural Warranty

Best Builders provides a 10-year structural warranty on all completed construction work, covering major structural defects in foundations, columns, beams, and slabs. This warranty is subject to the structure being used as intended and not being subjected to modifications, overloading, or negligent use.

10.2 Workmanship Warranty

A 1-year workmanship warranty is provided covering defects in plastering, waterproofing, tiling, painting, and other finishing works arising from poor workmanship.

10.3 Warranty Exclusions

Warranties do not cover:

  • Normal wear and tear, ageing, or weathering of materials
  • Damage caused by misuse, negligence, alterations, or additions by the client
  • Damage caused by natural disasters, floods, earthquakes, or Acts of God
  • Issues arising from client-supplied materials
  • Cosmetic damage or normal settlement cracks (hairline cracks)

🚫 11. Termination

11.1 Termination by Client

The client may terminate the agreement by providing 30 days' written notice. Upon termination, the client shall pay for all work completed to date, materials procured or ordered, and a reasonable demobilisation fee. Materials already purchased or fabricated shall be paid for in full.

11.2 Termination by Best Builders

Best Builders reserves the right to terminate the agreement with 14 days' written notice in the following circumstances:

  • Non-payment by the client beyond 30 days of due date
  • Discovery of fraudulent or materially inaccurate information provided by the client
  • Unsafe site conditions that cannot be resolved within a reasonable timeframe
  • Client's persistent failure to fulfil obligations despite written notice

⚖️ 12. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or in connection with these Terms or our services, the parties agree to the following resolution process:

  1. Negotiation (30 days): Both parties will attempt to resolve the dispute through good-faith negotiation within 30 days of written notice of the dispute.
  2. Mediation (30 days): If negotiation fails, either party may refer the dispute to a mutually agreed mediator. Mediation costs shall be shared equally.
  3. Arbitration: If mediation fails, the dispute shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed. The seat of arbitration shall be Ahmedabad, Gujarat.

Notwithstanding the above, Best Builders reserves the right to seek urgent injunctive relief from a court of competent jurisdiction.

🏛 13. Governing Law & Jurisdiction

These Terms and all agreements between Best Builders and its clients shall be governed by and construed in accordance with the laws of the Republic of India. Subject to the arbitration clause, the courts of Ahmedabad, Gujarat shall have exclusive jurisdiction over any disputes arising from these Terms or our services.
